This puppy/dog is in good physical health and free of communicable disease, as checked by a veterinarian, at the time of leaving the breeder’s premises. The buyer has seven (7) days to have this puppy/dog examined by a veterinarian of their choice. If the puppy is found to be unhealthy at this time, the buyer may return the puppy and all related paperwork to receive a replacement puppy of equal value (when available) or a full refund of the purchase price, with a written veterinarian report verifying illness. If the buyer chooses not to have this puppy/dog examined by a veterinarian within the mentioned time frame they accept this puppy/dog “as is” at the time of sale. Buyer realizes that the purchase of a live animal carries with it the risk of contracting various bacteria or viruses that are not in the control of either breeder or buyer and that taking the animal to high traffic areas increases this risk. Beyond the seven (7) day time frame, the seller offers NO GUARANTEE ON INFECTIOUS DISEASES OR PARASITES, including but not limited to parvovirus, leptospirosis, kennel cough, fleas and worms. This contract also guarantees that all animals have been vaccinated and wormed as noted on their health management documents.
The breeder guarantees this canine will never test "POSITIVE" or "AFFECTED" when tested through Embark, UC Davis, or Paw Print Genetics for the following diseases: Progressive Retinal Atrophy crd4/cord 1, Mucopolysaccharidosis Type IIIA, Sanfilippo Syndrome Type A, MPS IIIA, Neuronal Ceroid Lipofuscinosis 1, NCL 1, Neuronal Ceroid Lipofuscinosis 2, NCL 2, Narcolepsy, or Osteogenesis Imperfecta. The breeder guarantees this canine will have OFA ratings of "Normal: Fair" or above for Patellar Luxation. The breeder guarantees this canine is CAER eligible and does not have the following disorders: Keratoconjunctivitis sicca (KCS), Cataracts, Lens luxation or subluxation, Glaucoma, Persistent hyperplastic primary vitreous (PHPV), Retinal detachment, Retinal dysplasia, Optic nerve coloboma, nor Optic nerve hypoplasia.
In the event that one of the genetic health disorders listed, effects/renders this canine unsuitable as a companion animal, the buyer may surrender the canine with signed registration papers to the breeder, who will replace the original purchase with a puppy of equal value or a full refund. If the buyer does not want to surrender the puppy/dog, they will have the option of a partial refund equating to 50% of the original purchase fee. Request for replacement must be accompanied by verification of disease/defect/disorder by a qualified veterinarian at the buyer's expense. The breeder may request a second opinion to confirm defect/disease, at the breeder's expense. In the event of death, a letter from the buyer's veterinarian stating the cause of death and necropsy findings must be submitted to the breeder for replacement/full refund. A necropsy and results are required for a replacement/full refund. Replacement will be breeder’s choice of stock on hand or expected litters within two years (24 months). Replacement shall be of the same sex and coat type. All shipping/travel expenses are the sole responsibility of the buyer and are non-refundable.
The buyer agrees to maintain the health of this puppy/dog, which includes but is not limited to: adequate housing, proper nutrition, exercise, proper socialization, worming, flea and heartworm prevention, scheduled vaccinations and veterinary care, as needed. This puppy/dog will never be left tied or chained unsupervised. Any evidence of neglect or abuse will void all guarantees, and the breeder shall have the legal right to regain possession of the puppy/dog with no compensation to the buyer.
This puppy/dog cannot be resold to a pet shop/puppy broker or breeding program/facility nor any form of dog breeder. If the buyer can no longer care for this puppy/dog or no longer wants this puppy/dog, the breeder should be immediately notified. This puppy/dog may be returned to the breeder at any time, no refund will be given, but the breeder will help rehome the puppy, if necessary, and any rehoming fees, minus fees for board, feed and care, will be returned to the relinquishing party. Under no circumstances shall this puppy/dog be relinquished to an animal shelter, animal pound, animal rescue or any animal rights, or other animal politics group. The buyer (whether breeder or pet owner) shall not sell, trade, nor freely give away this puppy without expressed written permission from the breeder. This puppy/dog MUST be returned to the breeder if the buyer no longer wants this puppy or is no longer able to care for this puppy unless an agreement between breeder and buyer has been made for a new home.
No AKC Registration: Buyer has requested or been given further discounts which do not include AKC Paperwork. AKC Registration will NOT be furnished at any point in the animal's life. The buyer agrees to have this puppy/dog spayed/neutered by 12 months of age. Breeding this dog would be in violation of this contract.
Limited AKC Registration: The breeder will furnish Limited AKC registration papers to the buyer for a companion/competitive puppy, sold strictly as a pet and competition animal, upon proof of spay/neuter. The buyer agrees to have this puppy/dog spayed/neutered by 12 months of age. Breeding this dog would be in violation of this contract.
Full AKC Registration Option: If Full AKC registration has been agreed upon (prior to sale) for a show/breeding PROSPECT, the buyer fully understands that the breeder cannot guarantee size, future show quality or breeding ability of this puppy/dog. If this puppy/dog cannot produce puppies at all, due to an unforeseen genetic issue, the buyer may relinquish the puppy/dog for a full refund. If the buyer does not want to surrender the puppy/dog, they may request a refund of the “breeding rights” fee ($250). If the buyer tries to resell this puppy/dog as one capable of breeding abilities, or breeds this dog in the future, after filing for a full refund under these claims, the breeder shall have the legal right to regain possession of the puppy/dog with no compensation to the buyer AND pursue monetary damages of $5000 for violation/breach of contract. No other guarantees are expressed or implied under this contract except as stated above. Full registration papers will be issued by the breeder for this purpose. The buyer agrees to add the prefix SUNCHIME to the puppy/dog’s registered name.
Any violation/breach of this contract may result in monetary damages of $5000, all court costs and attorney’s fees collected by the breeder.
The buyer understands that the breeder cannot guarantee the adult size of this puppy.
A puppy pick up date will always be scheduled at/after 8 weeks of age. If the buyer requires the breeder to hold a puppy longer than 10 weeks, a $25 per week boarding fee will be applied to the purchase price. The buyer assumes full liability for this puppy/dog after leaving the breeder’s premises. Breeder assumes no responsibility for medical expenses incurred by buyer on behalf of this puppy/dog without written approval from Brianna Piper/SunChime Skyes. This contract is non-transferable.

This is a binding contract enforceable in a court of law. All legal inquiries and court hearings must take place in Pierce County, WA.

*Genetic defects are defined as physical problems impacting the animal’s well-being and not the result of other factors, such as environmental, injury, nutrition or natural aging. (Excludes any notable defects already listed in the 'Other Conditions' of this contract.)
*Please refrain from allowing your veterinarian to give your puppy a Leptospirosis vaccination! Lepto is included in many of the combination vaccines, but can be avoided, if requested. If vaccination with Lepto is given, and the puppy gets sick and dies, the health guarantee is VOID. We never give vaccinations containing Lepto to any puppies or adults, because of the potential life-threatening allergic reactions that may occur in the dachshund breed. If avoidance is impossible, please take all precautions to help the puppy through any reactions.
